By purchasing, activating, or using a XYNEX software product, you agree to these Terms of Service.

If you do not agree to these terms, you must not use the software.

These terms apply subject to applicable consumer protection laws and other mandatory legal requirements.

XYNEX grants customers a limited, personal, non-exclusive, non-transferable license to use purchased software during the applicable license period.

Purchasing a license does not transfer ownership of the software or its underlying intellectual property.

The license remains subject to the restrictions and conditions described in these terms.

XYNEX products are intended solely for private projects, authorized testing, and offline gaming environments.

Users may use the software only within this permitted scope and in compliance with applicable laws and third-party agreements.

The following activities are prohibited, except where applicable law expressly permits otherwise:

• Using XYNEX software in online multiplayer or competitive online games
• Sharing, reselling, or distributing license keys without authorization
• Circumventing license activation or authentication mechanisms
• Cracking or distributing modified unauthorized versions of the software
• Unauthorized redistribution of software files
• Attempting to access protected backend systems without authorization
• Using the products for malicious, fraudulent, or unlawful purposes
• Violating third-party intellectual property rights or applicable platform rules

Nothing in these terms restricts mandatory legal rights relating to reverse engineering, interoperability, or security research where such restrictions are prohibited by law.

Products may be distributed through time-limited licenses or other specifically advertised license models.

A license becomes usable after successful activation, subject to the applicable product terms.

Time-limited licenses remain valid for their specified duration.

Expired, revoked, or otherwise invalid licenses may result in restricted access to the software.

The exact activation and expiration rules must match the implemented licensing system and the terms presented at purchase.

XYNEX provides digital software products and digital license keys.

Where permitted by applicable law, customers may lose their statutory withdrawal right after digital delivery has begun, provided all legally required conditions have been satisfied, including any necessary express consent and acknowledgment.

Once a license has been redeemed or activated, refund requests based solely on a change of mind may be declined where legally permitted.

This policy does not affect mandatory statutory rights, including rights relating to defective digital products, nonconforming digital content, or other legally required remedies.

Any applicable withdrawal information and customer acknowledgment must be presented clearly during checkout.

Customers are responsible for keeping their license keys and account credentials confidential.

Unauthorized license sharing or attempts to bypass license restrictions may lead to suspension or termination of access, subject to applicable law.

XYNEX may provide software updates, compatibility improvements, security fixes, and feature changes.

Certain updates may be necessary to maintain security and compatibility.

Any obligations relating to updates or continued digital-service functionality remain subject to applicable consumer law.

XYNEX may suspend or terminate access in cases of material violations of these terms, fraudulent activity, unauthorized redistribution, or serious licensing abuse.

Any suspension or termination must comply with applicable law and contractual obligations.

XYNEX products may interact with external software environments.

XYNEX is not affiliated with third-party game developers or platform operators unless expressly stated.

Customers remain responsible for compliance with applicable third-party terms.

Software compatibility and performance may depend on the customer's system configuration and third-party environments.

XYNEX does not guarantee uninterrupted availability or compatibility with every external platform.

Nothing in these terms excludes or limits liability or statutory rights where such exclusion or limitation is prohibited by law.

XYNEX may update these Terms of Service where legally permitted.

Material changes should be communicated appropriately and must not override mandatory contractual or consumer rights.
